2. Object

These General Terms and Conditions of Sale govern access to and use of the Hui Zhen software, as well as the terms for subscribing to the available plans. Hui Zhen is a software platform designed for professionals, students, and individuals seeking access to information regarding acupuncture, Traditional Chinese Medicine, and the Tung acupuncture point system. The software includes, among other features:

• a directory of acupuncture points;

• 3D anatomical visualizations ;

• tools to support clinical analysis and reasoning;
• and patient record management functions, depending on the subscription plan chosen.

3. Subscription plans

‍

Essential plan

Price: €9.90 incl. tax per month.

Includes :

• point directory;
• 3D visualizations.

‍

Pro plan

Price: €59.90 incl. tax per month.

Includes :

• Everything in the Essential plan;
• diagnostic and observation support tools;
• patient records;
• advanced features that are currently available or added at a later date.

Prices may be changed at any time for new subscriptions. Existing subscribers will be notified in advance of any price changes.

‍

4. Trial period

‍

A 10-day free trial period may be offered. Users must provide a valid payment method upon registration. At the end of the 10 days, the subscription will automatically convert into a paid subscription, unless cancelled before the trial period ends.

No refunds will be granted if a user fails to cancel.

5. Payment

‍

Payments are made by bank card via the service provider Stripe. The user authorizes the automatic debit of the amount corresponding to the chosen plan on a monthly basis. Payment is due on the same day each month, based on the subscription start date.

‍

6. Duration and cancellation

‍

The subscription is for an indefinite period with automatic monthly renewal.

Users may cancel at any time via their personal account.

Cancellation takes effect at the end of the period already paid for. No partial or full refunds will be issued for any period that has already begun.

7. User account

‍

Each subscription is strictly personal. Access is limited to a single user per subscription.

The following are expressly prohibited:

‍

• sharing login details;
• simultaneous use by several people ;

• reselling access;
• making the account available to third parties.

‍

In the event of a violation, Meridiano Boreal Lda may immediately suspend or terminate the account, without any refund.

‍

8. Intellectual property

‍

All content from Hui Zhen is protected by intellectual property laws.

This includes, in particular:

• texts ;
• descriptions ;
• points locations, indications, therapeutic actions ;
• images ;
• illustrations and branding (logo, visual identity);
• 3D models;
• databases ;
• algorithms ;
• interfaces ;
• educational contents.

Any unauthorized reproduction, extraction, copying, translation, distribution, commercialization, or reuse is prohibited.

9.  Specific prohibitions

‍

The user agrees not to:

• copy the software's content on a large scale;
• create a competing database;
• extract data in an automated manner;
• use bots, scripts, or scraping tools;
• train an artificial intelligence model using the software's content;
• reproduce all or part of the document database;
• or resell or redistribute information obtained via Hui Zhen.

Any violation may result in the immediate termination of the account and legal action.

10. Nature of the information provided

The information provided within Hui Zhen is intended for informational, educational, and reflective purposes.

The tools offered—including those designed to assist with diagnosis—do not constitute a medical diagnosis, medical advice, or therapeutic recommendation.

They should be used with discernment and verified by the user before any decisions are made. The user remains solely responsible for their own professional, therapeutic, or personal actions.

11. Exclusion of liability

Meridiano Boreal Lda does not guarantee the accuracy, completeness, or ongoing timeliness of the information contained within the software.

The user acknowledges that:

• The data must be verified;
• the practice of acupuncture carries inherent risks;
• certain information may be subject to doctrinal or scientific disagreement.

Meridiano Boreal Lda shall not be held liable for:

• incorrect diagnosis;
• misinterpretation of information;
• treatment errors;
• bodily injury;
• indirect damages;
• financial loss;
• loss of clientele;
• or any consequences resulting from the use or misuse of the software.

12. Service availability

‍

Meridiano Boreal Lda strives to ensure the availability of the service, without guaranteeing continuous or uninterrupted access. Interruptions may occur for technical, maintenance, or security reasons. No compensation may be claimed on these grounds.

13. Health data

‍

The user remains solely responsible for the legality of the data they record in Hui Zhen. When using the patient management features, it is the user's responsibility to obtain all necessary authorizations, consents, and legal bases in accordance with applicable regulations.

14. Account suspension and deletion

‍

Meridiano Boreal Lda may immediately suspend or delete any account in the event of:

• fraud ;
• attempted hacking;
• haring of login credentials;
• violation of these Terms and Conditions of Sale;
• or actions detrimental to the company's interests.

No refunds will be provided in such cases.

15. Conditions modifications

‍

Meridiano Boreal Lda reserves the right to modify these terms and conditions at any time. The new terms and conditions will take effect upon their publication or on the date specified.

16. Applicable law et competent jurisdiction

‍

These General Terms and Conditions of Sale are governed by Portuguese law.

Any dispute shall be subject to the exclusive jurisdiction of the Portuguese courts, without prejudice to any mandatory provisions applicable to consumers.
